Welcome to ACLS Helper, an application designed to assist healthcare professionals during cardiac arrest emergencies, providing operational support and reminders based on the American Heart Association (AHA) guidelines.

 

By using this application, you fully agree to these Terms of Use and the Privacy Policy described herein.

Part I — Terms of Use

 

1. Purpose of the Application

ACLS Helper is intended to assist properly trained and qualified professionals in responding to cardiac arrest emergencies, offering decision-support tools and event logging features based on recognized protocols.

The application does not replace clinical judgment, professional training, or Advanced Cardiovascular Life Support (ACLS) certification, and must not be used by unqualified individuals to perform emergency medical procedures.

 

2. Target Audience and Authorized Use

The use of this application is restricted to qualified healthcare professionals, such as physicians, nurses, physiotherapists, and other professionals who have completed formal ACLS training or equivalent.

ACLS Helper does not provide medical, nursing, or any other healthcare services. The application is a technological tool for operational support and does not establish a physician-patient relationship between the developers and the users or their patients.

The content of the application is based on public guidelines from the American Heart Association (AHA) current at the time of development. The AHA may update its guidelines at any time, and the application may not immediately reflect such updates.

 

4. Limitation of Liability

To the maximum extent permitted by applicable law, the developers, contributors, partners, and affiliates of ACLS Helper shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

This limitation applies regardless of the legal theory invoked (contractual, tort, strict liability, or negligence) and even if the developers have been previously informed of the possibility of such damages.

The application is provided "as is" and "as available", without warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.

 

5. Data and Privacy

ACLS Helper collects and stores data necessary for the operation of the application. Full details on what data is collected, how it is processed, stored, shared, and protected are provided in Part II — Privacy Policy of this document.

The user acknowledges that they are solely responsible for ensuring compliance with applicable patient data protection regulations in their jurisdiction (including, as applicable, LGPD, GDPR, HIPAA, or equivalent legislation) when recording procedure data in the application.

 

6. Intellectual Property

All content of the ACLS Helper application, including but not limited to source code, design, user interface, text, icons, logos, sounds, trademarks, and graphic elements, is the exclusive property of TNZ Solutions or its licensors, protected by Brazilian and international intellectual property laws.

The medical guidelines presented in the application are based on publications by the American Heart Association (AHA). ACLS Helper has no affiliation, endorsement, or association with the AHA or any other medical organization.

 

7. Plans and Payments

ACLS Helper offers two usage tiers:

Payment transactions are processed exclusively by Apple App Store and Google Play Store, according to the terms and policies of each platform. The ACLS Helper developers do not have access to payment data (credit card, bank details, etc.) of users.

Refund policies follow the rules of the platform where the purchase was made (Apple or Google). The developers do not process refunds directly.

The developers reserve the right to change prices, features included in each plan, and payment terms at any time, with prior notice to the user.

 

8. Advertising

The FREE plan of ACLS Helper displays advertisements provided by Google AdMob. By using the application, the user consents to the display of such advertisements.

Google AdMob may collect device and usage data for ad personalization, in accordance with the Google Privacy Policy. The user can manage their ad preferences in their device or Google account settings.

The ACLS Helper developers are not responsible for the content of advertisements displayed by third parties, nor for any transactions between the user and advertisers.

 

9. Availability and Maintenance

The developers do not guarantee that the application will be available on an uninterrupted basis, or free from errors or failures. The application may be temporarily unavailable due to maintenance, updates, technical failures, infrastructure issues, or force majeure.

Under no circumstances shall the developers be liable for losses or damages resulting from the unavailability, modification, or discontinuation of the application.

 

10. User Conduct

The user agrees to use the application ethically, lawfully, and in compliance with these Terms of Use. The following actions are expressly prohibited:

Violation of these rules may result in the immediate suspension or deletion of the user's account, without prior notice and without the right to a refund.

 

11. Account and Data Deletion

The user may request the deletion of their account at any time directly through the application, by accessing the profile screen.

Upon account deletion:

The developers reserve the right to delete accounts that have been inactive for more than 24 (twenty-four) months, with prior notification to the registered email address.

 

ACLS Helper is developed in compliance with Brazilian legislation, including:

For users located in the European Union, data processing complies, where applicable, with the General Data Protection Regulation (GDPR) — Regulation (EU) 2016/679.

For users located in the United States, the developers do not guarantee compliance with specific state legislation (such as CCPA, HIPAA, or similar). The user is responsible for verifying the adequacy of the application's use under the applicable regulations in their jurisdiction.

13. Changes to the Terms of Use

The developers reserve the right to modify these Terms of Use at any time, without the need for prior individual consent. Changes will take effect immediately upon publication of the updated version.

Continued use of the application after the publication of changes constitutes full acceptance of the new Terms. If the user does not agree with the changes, they must immediately stop using the application and, if desired, delete their account.

The date of the last update will always be indicated at the end of this document.

 

14. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil.

For the resolution of any disputes arising from these Terms or the use of the application, the Courts of the City of São Paulo, State of São Paulo, Brazil are hereby elected as the exclusive jurisdiction, to the exclusion of any other, however privileged.

If the user is located in a jurisdiction where local legislation prevents the selection of jurisdiction, disputes shall be resolved in the competent court of the user's domicile.

The user agrees to indemnify, defend, and hold harmless the developers, contributors, partners, directors, employees, and affiliates of ACLS Helper and TNZ Solutions from any and all losses, damages, costs, expenses (including reasonable attorney's fees), claims, lawsuits, or third-party demands arising from:

Users' personal data may be transferred to and stored on servers located outside the user's country of residence, including, but not limited to, Google Cloud Platform servers in the United States and other regions.

Personal data will be retained for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.

After account deletion, data will be permanently removed from Firebase Firestore and the local cache. Data may remain in infrastructure backups for a limited period, in accordance with Firebase (Google Cloud) platform policies, before being permanently eliminated.

 

25. User Rights

In compliance with LGPD, GDPR, and other applicable data protection legislation, the user has the following rights regarding their personal data:

In-app account deletion: the user can delete their account at any time directly through the application, by accessing the profile screen. Upon account deletion, all user data is permanently removed from Firebase Firestore and the local cache. This action is irreversible.

ACLS Helper is intended exclusively for healthcare professionals aged 18 and older. We do not knowingly collect personal data from children or minors under the age of 18.

28. Patient Data

ACLS Helper allows the user to record data related to patient procedures, including name, age, weight, and gender. It is the sole responsibility of the user to:

The developers do not access, view, or process patient data entered by the user. This data is accessible exclusively to the authenticated user through Firebase security rules.

The developers are not responsible for any patient privacy violations resulting from the user's improper use of the application.
